As newly appointed President of the Chartered Institute of Trade Mark Attorneys (CITMA), we were delighted when Daniel Hardman-Smart accepted our invitation to be one of our guest bloggers. In his blog, Daniel talks about the UK as a leading environment for intellectual property, particularly in relation to trade marks, and what this means in practice for businesses looking to protect and grow their brands.

The United Kingdom is world-leader in intellectual property. It is a global hub for protecting rights such as trade marks and designs, and it is an asset to businesses both in the UK and worldwide.
Trade marks, the area I work in, is a particular gem. It is not just me saying this. The latest US Chamber of Commerce International IP Index ranks the UK second in the world overall for IP, and joint first, with a perfect score, for trade marks.
We are set to welcome some 10,000 of the worlds intellectual property legal professionals to London for a largescale event in the coming weeks. It is a great opportunity to showcase what the UK has to offer – both culturally and in terms of protecting IP. Here are some of the things I’ll be talking with colleagues from across the globe about.

Our legal framework is among the most mature and sophisticated in the world. We have specialist intellectual property courts that are respected across jurisdictions. They provide cost-effective and enforceable decisions that help protect businesses.
And our Chartered Trade Mark Attorneys are recognised internationally for their expertise and commercial judgement.
The bottom line is that the UK gives your trade mark the protection it deserves.
What does that mean for your business?
If you trade under a name, sell under a logo, or have built a reputation that customers recognise and return to, you already have something worth protecting.
The UK's world-class IP system exists to help you do exactly that - efficiently, reliably, and with legal protection that commands respect at home and internationally.
Whether you are registering your first trade mark or managing a portfolio that spans multiple markets, you are operating within one of the most sophisticated IP environments anywhere in the world.
Your trade mark is one of your most valuable assets
Your trade mark is not just a legal formality. It is often one of the most valuable assets your business owns - and unlike most assets, it can continue to grow in value.

Every time a customer sees your brand, chooses your product and has a positive experience, the goodwill attached to your trade mark increases. That goodwill is real, transferable and commercially significant.
It is what enables licensing deals, underpins franchise agreements, can attract investment or help secure funding, and is often what buyers are really purchasing when they acquire a business.
Your brand may be at an earlier stage, but the principle is the same. Protect it properly, use it consistently, and it will work harder and harder for your business over time.
Your trade mark is working harder than you think
At its most fundamental level, your trade mark leads consumers to your products and services and encourages them to choose you over a competitor. When a customer has tried what you have to offer, benefited from it and wants to buy again, it is your trade mark they rely on to know that it is you.
In an increasingly competitive marketplace, that ability to stand out and be remembered is the foundation of everything.
But your trade mark does far more than that.
It advertises your product and persuades consumers to buy from you rather than a rival. It acts as a guarantee of quality - a promise to your customers that their experience will be consistent and trustworthy.
It can also help communicate everything about who you are as a business: showing off your values, your price point, your heritage. Consumers today ask more of brands than ever before, and as your business grows, that communicative power only becomes more important.
The UK Intellectual Property Office has earned an outstanding reputation for the quality of its decisions and the transparency of its processes. A UK trade mark registration is also an effective launchpad for international protection, giving businesses with global ambitions a powerful and reliable starting point.
And if infringement occurs, our courts are equally strong. UK IP judges are respected worldwide for their expertise and impartiality. Decisions of the English courts carry real persuasive weight internationally, meaning a successful outcome in the UK can help drive settlements far beyond our borders.
Expert help, built around your business
Behind the UK's world-leading system is a profession built to help businesses like yours make the most of it.
CITMA represents the qualified trade mark attorneys who advise businesses of every size, from every sector, across the UK and internationally. Our members undergo rigorous training designed to produce commercially minded, pragmatic advisers. Their goal is not simply to secure legal protection - it is to help you achieve your business objectives.
Your Chartered Trade Mark Attorney will help ensure that your mark is distinctive enough to stand out in the marketplace and fulfil its vital role of identifying your products and building consumer confidence. They will advise on registration strategy, international expansion, licensing opportunities and, where necessary, enforcement. Hopefully, enforcement is not necessary – and having a registration provides deterrent value.
A Chartered Trade Mark Attorney will help you protect what you think is yours by getting to know your business and its priorities and plans for growth, always with that end point in mind, “what if we need to enforce this?”.
In short, they help you protect and grow one of your most valuable business assets.
Is your brand properly protected - at home and in the markets where you operate or aspire to reach? Are you making the most of what your trade mark can do for your business?
Your trade mark is already working hard for you. Make sure it has the protection it deserves.
